CEDARVALE PARK - SANDY CREEK Terms and Conditions
1. Parties
1.1. This is an agreement between Cedarvale Park and You.
2. Definitions
“We”, “Us”, “Our” or “CVP” means Cedarvale Park (ABN: 15 366 998 564). “Long Weekend” means any weekend that on the Friday prior or the Monday after are a public holiday, including all regional specific holidays, as determined by the Queensland Government and the applicable Local Councils. “Mid Peak Season” means the Queensland School Holidays as released by the Queensland Department of Education from time to time. “Peak Season” means between the following dates and as varies each year, 23 December 2021 to 1 January 2022, 14 April 2022 to 17 April 2022, and 23 December 2022 to 1 January 2023; or as varied from time to time. “Related Parties” includes employees, affiliates, subsidiaries, agents, associates, partners, directors. “Services” means camping or activities offered by Cedarvale Park or held within the premises of Cedarvale Park. “Standard Booking” means a booking other than a Peak Season booking, Mid Peak Season booking, or Long Weekend booking. “You” means the person using the Services or the parent or guardian that signs this document.
3. Photographic Identification
3.1. When you check-in you may be asked to provide photographic identification.
3.2. If you are unable to provide such identification your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term.
4. Compulsory Covid-19 Check-in
4.1. When you check-in you may be asked to check in with the Queensland Covid-19 app or fill in the paper form.
4.2. If you are unable or unwilling to sign-in your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term 2
4.3. If you or any people under your booking have been in a Covid-19 hotspot as declared by the Queensland Department of Health within two weeks of your check-in date we may refuse entry to the park and cancel your booking, if so, you will receive a full refund.
4.4. If you refuse to provide a declaration or mislead or deceive on your declaration, we may refuse entry to the park and your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term.
5. Booking, Quotes and Reservations
5.1. Bookings can be made online via any of the Participating Websites or with CVP directly.
5.2. Bookings are subject to the availability and applicable pricing at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements.
5.3. Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from CVP that the payment has been received and the booking has been confirmed.
5.4. Any confirmed price is subject to change if:
5.4.1. a payment which is due on a booking is not received by CVP by the date the payment is due; or
5.4.2. there is a change in or imposition of a government charge, tax or levy which entitles or necessitates CVP changing the price of your booking.
5.4.3. any details relating to your booking are amended, for example Your dates of stay, Your site type or the number of persons staying under your booking, in which case clause 13 will apply.
5.5. If the price of a booking is changed under clause 5.4 you may pay the new price for your booking or cancel your booking and receive a full refund.
5.6. If you reasonably believe a written confirmation or invoice which has been provided to you is incorrect, you can request that CVP reissue that written confirmation or invoice and you may either pay the amount specified on the reissued written confirmation or invoice by the date which it is specified as being due, or cancel your booking.
6. Conditions of Booking
6.1. As part of the conditions of booking with Us, You are to abide by our Terms and Conditions and sign our Waiver. These are available from reception or on our website at https://www.cedarvalepark.com.au/.
6.2. Confirmation of your booking must be displayed at all times on the registered vehicle with the booking 3
6.3. You are responsible and liable for the behaviour of any person staying under your booking or visitor to your site. Any breach of these rules by any person staying under your booking or visitor to your site is held to be a breach by You.
7. Minimum Length of Stay
7.1. Minimum length of stay conditions apply and vary by season.
7.2. Minimum length of stay for online bookings may differ to conditions for bookings made with CVP directly.
7.3. The Minimum length of stay during Peak Season is four nights.
7.4. The Minimum length of stay during Mid Peak Season is two nights.
7.5. The Minimum length of stay during a Long Weekend is three nights.
8. Pets
8.1. Pets are welcome on application to CVP. Bookings with pets may be made directly with CVP by phone or email. Online bookings are/are not available for pet friendly sites.
8.2. Service animals accompanying persons with disabilities are always accepted.
8.3. Otherwise only one small dog is permitted unless prearranged and at the complete discretion of Us.
8.4. Dogs are permitted to stay in CVP all the year round, under the complete discretion of Us.
8.5. Dogs listed as restricted on the Queensland Restricted Dog List will not be permitted into CVP.
8.6. The dog must comply with local legislation requirements and will be required to wear a leash or be otherwise restrained or confined.
8.7. The dog must be up-to-date on all vaccinations. Proof of vaccinations will be required at time of check-in.
8.8. You must abide by the rules set forth and must sign our Waiver.
8.9. The dog must be well mannered and appropriately restrained by the guest at all times.
8.10. The dog may only be left unattended for short periods when the owner is using a facility where dogs are not permitted. Dogs must remain secure and not cause a disturbance.
8.11. You are responsible for cleaning up after your dog on CVP property and in the neighbourhood. 8.12. Any disturbances such as barking must be curtailed to ensure other guests are not inconvenienced. You will be asked to leave if noise continues.
8.13. You are responsible for all property damages and/or personal injuries resulting from your pet.
8.14. CVP reserves the right to charge Your account commensurate to the cost of such damages
8.15. If the dog acts in any way considered aggressive, dangerous or destructive, We have the right to ask guests to leave the CVP, in which case they will not be entitled to any refund.
9. Child Policy
9.1. For the purposes of this clause “Child” or “Children” means a person or persons aged between 2 years and 11 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged over 16 years. All ages will be determined from the date at which accommodation commenced.
9.2. Children and Infants sharing a site with their parents or guardians may do so free of change so long as they do not exceed the maximum occupancy for the given site type.
9.3. Children and Infants may not stay in any site without an Adult. 9.4. Persons under the age of 18 are not permitted to make an online reservation. We reserve the right to cancel any of these types of reservations.
9.5. All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18 year old guest.
9.6. If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult CVP may immediately cancel the guest's booking and the full booking amount will be forfeited to CVP under this clause.
10. Payments For Bookings
10.1. Payments may be made by Visa, Mastercard, American Express, PayPal, Australian Dollar personal or bank cheques/drafts or Telegraphic Transfer (allow 7 days transaction time.
10.2. A non-refundable card surcharge will apply to payments made by Visa, Mastercard, American Express. Fees will apply to payments made by PayPal. The surcharge applied to these cards may vary and is displayed at the time payment for the booking is to be made.
10.3. If you pay for your booking by cheque:
10.3.1. Post your cheque to the following address: Ceadervale Park Attention: Accounts 229 Cedarvale Road Sandy Creek QLD 4515
10.3.2. You must ensure you include the following details with your cheque:
10.3.2.1. Your booking number reference;
10.3.2.2. the name Your booking was made under; and
10.3.2.3. the dates of Your stay
10.3.3. You must ensure that CVP receives your cheque 5 days before the date Your payment is due to allow time for Your cheque to be cleared; and
10.3.4. if Your cheque has not cleared prior to your scheduled date of check-in you will not be permitted to check-in unless you provide an alternative form of payment.
10.4. CVP accepts no responsibility for monies paid by you to a travel agency until cleared funds are received in the bank account of CVP.
11. Deposit And Final Payment
11.1. For Standard Bookings full payment must be received at least 30 days prior to your scheduled day of arrival or, if your booking is made within 30 days of your scheduled day of arrival, at the time of booking.
11.2. For Peak Season, Mid Peak Season, and Long Weekend bookings full payment is required at the time of booking to guarantee your booking.
11.3. If any deposit or final payment is not received by the due date, CVP reserves the right to cancel the booking and any monies paid by you in relation to your booking will be forfeited to CVP.
11.4. Once final payment of your booking has been made confirmation of that payment and your booking will be sent to you via email or post to the email or postal address you provided at the time you made the booking.
12. Rates And Charges
12.1. The currency applicable to any quoted rates will be specified with the quoted rate. All quoted rates are subject to change at any time until full payment is received.
12.2. Quoted rates are inclusive of all compulsory government or regulatory charges and taxes (for example GST) where applicable.
12.3. Quoted rates do not include transport to or from CVP or items of a personal nature including but not limited to firewood, telephone, taxis, unless otherwise indicated.
12.4. Some rates which are quoted are valid only for a minimum number of nights and if the number of nights included in your booking changes the rate may also change.
13. Amendments
13.1. All amendments are subject to the availability and applicable pricing of CVP at the time the amendment is requested.
13.2. Amendments for Standard Bookings may be requested up to 48 hours prior to your scheduled check-in time.
13.3. Amendments for Peak Season Bookings, Mid Peak Season, and Long Weekend Bookings may only be requested up to 14 days prior to your scheduled check-in time.
13.4. If amendments are requested outside the time frames specified you may be charged a 100% cancellation fee in addition to the cost of your amended booking and any reduction in the amount which is payable by you in such case will be at CVP’s absolute discretion.
13.5. Amendments may be requested in the following manner:
13.5.1. Up to 30 days prior to your scheduled check-in time: via our website, or reservation service by calling 07 5498 1032 or emailing info@cedarvalepark.com.au.
13.5.2. Up to 48 hours of your scheduled check-in time: via our reservation service by calling 07 5498 1032.
13.6. The following charges will apply to amendments requested and approved:
13.6.1. Up to 10 days prior to your scheduled check-in time: no amendment fee will apply.
13.6.2. Within 10 days of your scheduled check-in time: a $5.00 amendment fee will apply.
13.7. If the rate which applies to an amended booking is greater than the rate which applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.
14. Site Allocation
14.1. Site allocation is at CVP’s discretion. Site preference is requested but no guarantee of a particular site is given to You. Your site allows for one car and your camping setup (van/tent/camper trailer) with up to a metre separation to the boundaries. Consult closely with CVP staff and CVP map to know exactly what the layout of your site is and how to best fit onto it comfortably.
15. Cancellation 15.1. For Standard Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.1.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.1.2. Within 14 days but up to 72 hours of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.1.3. Within 72 hours of your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid. 15.2. For Mid Peak Season Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.2.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.2.2. Within 30 days but up to 72 hours of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.2.3. Within 72 hours of your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid.
15.3. For Long Weekend Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.3.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.3.2. Within 30 days but up to 7 days of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.3.3. Within 7 days prior to your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid.
15.4. For Peak Season Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.4.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.4.2. Within 30 days but up to 14 days of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.4.3. Within 14 days prior to your scheduled check-in time: a 50% cancellation fee will apply and you will be required to pay to CVP 50% of the full amount of your booking fee less any amount which you have already paid.
15.5. Any cancellation fees payable by you will be deducted from any monies paid by you to CVP and if insufficient funds are available, CVP may charge, and you authorise CVP to charge, the credit card the details of which you provided at the time of making your booking.
15.6. Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be held by CVP as Booking Credit which subject to clause 10 may be applied to any future bookings you make with CVP.
15.7. Any surcharge applied to credit cards at the time payment for the booking is made will not be refunded.
15.8. The above clauses apply to cancellations due to any of the following:
15.8.1. disease
15.8.2. earthquakes, fires or other physical natural disaster
15.8.3. acts of war, acts of terrorism, riots, civil or military disturbances, national or state-wide industrial disputes (excluding actions by, between or originated among employees of a party); and
15.8.4. requisition or compulsory acquisition by any government or public authority
16. No-Shows Or Terminations
16.1. If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will be required to pay to CVP the full amount of your booking less any amount which you have already paid.
17. Refunds
17.1. Any amount paid by you to CVP for your booking (including deposits) shall be dealt with as stated in these Terms and Conditions.
18. Booking Credit
18.1. If you have been issued with Booking Credit to be applied to future accommodation or accommodation package bookings with CVP such credit will remain valid for twelve months from the day the booking is cancelled.
18.2. Booking Credit may only be used to pay for bookings at CVP.
18.3. Booking Credit may only be used to pay for the accommodation portion of your booking and may not be used for non-accommodation items such as firewood, activities or taxes not included in accommodation rates.
18.4. To redeem Booking Credit you must make your booking via our website, or reservation service by calling 07 5498 1032 or emailing info@cedarvalepark.com.au.
18.5. Any stay to be fully or partly paid for using Booking Credit must be booked and paid for in full prior to the expiry of the 12 month validity period.
18.6. Any Booking Credit not redeemed at the expiry of the 12 month validity date will be forfeited in its entirety to CVP.
18.7. Administration fees may apply to bookings made using Booking Credit.
19. Security Deposits
19.1. You must provide a credit card authorisation or imprint when you check-in and must make full payment for your booking at that time.
19.2. The authorisation may be used to cover incidental items including but not limited to a security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.
19.3. The pre-authorisation process validates your credit card, and protects both the cardholder and merchant from increasing fraud incidents.
19.4. The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit. For more information on this practice please contact your card issuer.
19.5. Once a pre-authorisation has been made, CVP cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer, and cannot be negotiated.
19.6. Where a credit card is not available a minimum $50.00 cash deposit will be required on check-in.
20. Check-in
20.1. Standard check-in time is 1:00pm AEST but times may vary per on season and you should confirm the check-in time with Us prior to your scheduled check-in day.
20.2. If you wish to guarantee your ability to check-in prior to 1:00pm AEST you must book an additional nights stay and pay the applicable rate for that additional night.
21. Check-Out: Standard
21.1. Standard check-out time is 10:00am but times may vary per season and you should confirm the check-out time with Us prior to your scheduled check-out day.
22. Late Check-Out
22.1. If you wish to check-out later than the standard check-out time you must obtain approval from Us at least 12 hours prior to your scheduled check-out time.
22.2. We may approve a request for late check-out in Our absolute discretion.
22.3. If you check-out after 10:00am the following additional charges will be applied to your account and will be payable by you on check-out:
22.3.1. a surcharge of $5.00 per hour for every hour after 10:00am that you fail to check-out; or
22.3.2. if you check-out after 1pm a charge equivalent to the fully daily rate which applies to your booking.
23. Facilities and Services
23.1. Whilst care is taken to ensure that the description of facilities and services of the CVP is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature/facility is essential to you in choosing a particular site or when determining to stay with us, it is
your responsibility to confirm with CVP prior to making your booking that the feature/facility will be available during your stay. 23.2. To the extent permitted by law CVP is not liable for omissions, errors or changes to the facilities and services at CVP, whether temporary or permanent.
23.3. Please report any breakages, damages, downed trees or dangerous animals to CVP.
24. Maps and Images
24.1. Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided
24.2. Destination shots may have been supplied to CVP by third parties and CVP does not guarantee the accuracy of any destination shots.
24.3. Photos and site maps are indicative only. Actual sites occupied may vary in appearance from those shown.
25. Travel Insurance
25.1. CVP strongly recommends that at the time of booking you purchase comprehensive travel insurance to cover items including but not limited to: loss of booking amount through cancellation, loss or damage to personal camping equipment, loss of money and medical expenses.
26. Personal Transportation:
26.1. Mini-bikes, motorised scooters, motorcycles, are prohibited from use at CVP.
26.2. All vehicles must be appropriately registered and operators must have a valid driver’s license.
26.3. The speed limit at CVP is 10kph everywhere and 5kph in the camping area.
26.4. It is prohibited to drive:
26.4.1. on any banks in the camping area;
26.4.2. a noisy vehicle.
26.4.3. under the influence of alcohol or drugs
26.5. All animals and pedestrians have the right of way.
26.6. Beware of trees/limbs that may fall on your camp.
26.7. All vehicles must drive on the tracks at all times.
26.8. All tracks will be closed after rain at the discretion of CVP.
26.9. Please be kind to our neighbours and drive slowly and obey the road rules along the dirt road.
26.10. We have the right to ask guests to leave the CVP if they breach this clause, in which case they will not be entitled to any refund.
27. Caravans, Campervans and Trailers
27.1. All caravans, campervans and powered trailers must have a current electrical warrant of fitness.
27.2. Power leads must be a minimum of 10m in length.
27.3. You must provide own waste container and empty chemicals toilets in dump station provided.
28. Day Visitors
28.1. Day visitors to the park must pay a $10 entry fee. This fee is non-refundable.
28.2. Day visitors are only permitted within the hours of 10:00am to 9:00pm AEST.
28.3. You are responsible and liable for the behaviour of any person staying under your booking or visitor to your site.
28.4. Any breach of these rules by any person staying under your booking or visitor to your site is held to be a breach by You.
29. Hazardous Materials 29.1. Hazardous materials are absolutely prohibited at CVP and includes but not limited to:
29.1.1. hazardous machinery (e.g. chainsaws)
29.1.2. firearms
29.1.3. fireworks
29.1.4. hazardous chemicals excluding the following provided they meet the regulatory requirements and are disposed of appropriately:
29.1.4.1. fire starters
29.1.4.2. gas bottles
29.1.4.3. chemical toilets, porta-loos or toilet cassettes
30. Noise
30.1. At CVP we have noise restrictions between the hours of 10:00pm to 7:00am AEST.
30.2. Music is not permitted without the authorisation of CVP management.
30.3. Noise generating appliances are not permitted without the authorisation of CVP management.
30.4. Where generator use is allowed, there may be restrictions on noise level output and hours of use.
30.4.1. Only low decibel (dB) generators, up to 2.0 Kva, with a maximum noise level output of up to 65 dB at 7 m are appropriate in our camp sites, unless otherwise specified.
31. Fire
31.1. In compliance with the Fire and Emergency Services Act 1990 fires may only be lit within the designated fire rings provided and must not exceed two metres in height, width or length.
31.2. Fires must be monitored by an adult at all times and must be fully extinguished prior to leaving the site and going to sleep.
32. Theft and Wilful Damage
32.1. Any person caught stealing, damaging or destroying property (including plant and wildlife) will be prosecuted and/or required to pay for the damage.
32.2. We have the right to ask guests to leave the CVP, in which case they will not be entitled to any refund.
32.3. Please ensure that you keep all valuables secure, put away recreation equipment, lock your doors and ensure all vehicles are secure.
32.4. CVP and its Related Parties are not responsible or liable for any loss, theft, or damage of your personal property.
33. Abuse of Staff or CVP
33.1. Misconduct, profanity, theft, vandalism and abuse towards staff will not be tolerated.
33.2. We have the right to ask guests to leave the CVP and ban then from future entry, in which case they will not be entitled to any refund.
33.3. Should you refuse to leave or leave within a reasonable time CVP under the direction of our staff you will be deemed as having trespassed. We may within the limits of the law, use reasonable force to eject you and your property from CVP.
33.4. We may contact the authorities to remove you from CVP.
34. Release, Indemnity and Proportionate Liability
34.1. To the extent permitted by the law, you agree to release, indemnify and hold harmless, CVP and its Related Parties from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at CVP except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from CVP’s negligence, wrongful act/omission or breach of these terms and conditions.
34.2. To the extent permitted by law the aggregate of CVP’s liability to you is limited to an amount not exceeding the amount paid by you for your booking.
34.3. Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.
35. Consumer Law
35.1. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on CVP are excluded under these Terms and Conditions.
35.2. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits CVP to limit its liability, then CVP’s liability is limited to:
35.2.1. in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
35.2.2. in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
36. Events Beyond Control
36.1. CVP is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
36.2. All travel documents, observance of laws and government regulations are your responsibility.
37. Use Of Information
37.1. You consent and authorise CVP to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
37.2. You consent to information which you have provided to CVP as part of your booking being used by CVP or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate CVP or CVP’s related bodies corporate.
37.3. CVP will not provide or disclose any information you have provided to CVP to any person other than a related body corporate without your prior written consent.
37.4. Upon request by you and to the extent permitted or required by law, CVP will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

38. General
38.1. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Queensland, Australia.
38.2. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

“We”, “Us”, “Our” or “CVP” means Cedarvale Park (ABN: 15 366 998 564). “Long Weekend” means any weekend that on the Friday prior or the Monday after are a public holiday, including all regional specific holidays, as determined by the Queensland Government and the applicable Local Councils. “Mid Peak Season” means the Queensland School Holidays as released by the Queensland Department of Education from time to time. “Peak Season” means between the following dates and as varies each year, 23 December 2021 to 1 January 2022, 14 April 2022 to 17 April 2022, and 23 December 2022 to 1 January 2023; or as varied from time to time. “Related Parties” includes employees, affiliates, subsidiaries, agents, associates, partners, directors. “Services” means camping or activities offered by Cedarvale Park or held within the premises of Cedarvale Park. “Standard Booking” means a booking other than a Peak Season booking, Mid Peak Season booking, or Long Weekend booking. “You” means the person using the Services or the parent or guardian that signs this document.
3. Photographic Identification
3.1. When you check-in you may be asked to provide photographic identification.
3.2. If you are unable to provide such identification your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term.
4. Compulsory Covid-19 Check-in
4.1. When you check-in you may be asked to check in with the Queensland Covid-19 app or fill in the paper form.
4.2. If you are unable or unwilling to sign-in your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term 2
4.3. If you or any people under your booking have been in a Covid-19 hotspot as declared by the Queensland Department of Health within two weeks of your check-in date we may refuse entry to the park and cancel your booking, if so, you will receive a full refund.
4.4. If you refuse to provide a declaration or mislead or deceive on your declaration, we may refuse entry to the park and your booking may be cancelled and you may be liable to pay CVP an amount equal to the full booking amount plus any other costs incurred by CVP in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CVP under this term.
5. Booking, Quotes and Reservations
5.1. Bookings can be made online via any of the Participating Websites or with CVP directly.
5.2. Bookings are subject to the availability and applicable pricing at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements.
5.3. Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from CVP that the payment has been received and the booking has been confirmed.
5.4. Any confirmed price is subject to change if:
5.4.1. a payment which is due on a booking is not received by CVP by the date the payment is due; or
5.4.2. there is a change in or imposition of a government charge, tax or levy which entitles or necessitates CVP changing the price of your booking.
5.4.3. any details relating to your booking are amended, for example Your dates of stay, Your site type or the number of persons staying under your booking, in which case clause 13 will apply.
5.5. If the price of a booking is changed under clause 5.4 you may pay the new price for your booking or cancel your booking and receive a full refund.
5.6. If you reasonably believe a written confirmation or invoice which has been provided to you is incorrect, you can request that CVP reissue that written confirmation or invoice and you may either pay the amount specified on the reissued written confirmation or invoice by the date which it is specified as being due, or cancel your booking.
6. Conditions of Booking
6.1. As part of the conditions of booking with Us, You are to abide by our Terms and Conditions and sign our Waiver. These are available from reception or on our website at https://www.cedarvalepark.com.au/.
6.2. Confirmation of your booking must be displayed at all times on the registered vehicle with the booking 3
6.3. You are responsible and liable for the behaviour of any person staying under your booking or visitor to your site. Any breach of these rules by any person staying under your booking or visitor to your site is held to be a breach by You.
7. Minimum Length of Stay
7.1. Minimum length of stay conditions apply and vary by season.
7.2. Minimum length of stay for online bookings may differ to conditions for bookings made with CVP directly.
7.3. The Minimum length of stay during Peak Season is four nights.
7.4. The Minimum length of stay during Mid Peak Season is two nights.
7.5. The Minimum length of stay during a Long Weekend is three nights.
8. Pets
8.1. Pets are welcome on application to CVP. Bookings with pets may be made directly with CVP by phone or email. Online bookings are/are not available for pet friendly sites.
8.2. Service animals accompanying persons with disabilities are always accepted.
8.3. Otherwise only one small dog is permitted unless prearranged and at the complete discretion of Us.
8.4. Dogs are permitted to stay in CVP all the year round, under the complete discretion of Us.
8.5. Dogs listed as restricted on the Queensland Restricted Dog List will not be permitted into CVP.
8.6. The dog must comply with local legislation requirements and will be required to wear a leash or be otherwise restrained or confined.
8.7. The dog must be up-to-date on all vaccinations. Proof of vaccinations will be required at time of check-in.
8.8. You must abide by the rules set forth and must sign our Waiver.
8.9. The dog must be well mannered and appropriately restrained by the guest at all times.
8.10. The dog may only be left unattended for short periods when the owner is using a facility where dogs are not permitted. Dogs must remain secure and not cause a disturbance.
8.11. You are responsible for cleaning up after your dog on CVP property and in the neighbourhood. 8.12. Any disturbances such as barking must be curtailed to ensure other guests are not inconvenienced. You will be asked to leave if noise continues.
8.13. You are responsible for all property damages and/or personal injuries resulting from your pet.
8.14. CVP reserves the right to charge Your account commensurate to the cost of such damages
8.15. If the dog acts in any way considered aggressive, dangerous or destructive, We have the right to ask guests to leave the CVP, in which case they will not be entitled to any refund.
9. Child Policy
9.1. For the purposes of this clause “Child” or “Children” means a person or persons aged between 2 years and 11 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged over 16 years. All ages will be determined from the date at which accommodation commenced.
9.2. Children and Infants sharing a site with their parents or guardians may do so free of change so long as they do not exceed the maximum occupancy for the given site type.
9.3. Children and Infants may not stay in any site without an Adult. 9.4. Persons under the age of 18 are not permitted to make an online reservation. We reserve the right to cancel any of these types of reservations.
9.5. All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18 year old guest.
9.6. If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult CVP may immediately cancel the guest's booking and the full booking amount will be forfeited to CVP under this clause.
10. Payments For Bookings
10.1. Payments may be made by Visa, Mastercard, American Express, PayPal, Australian Dollar personal or bank cheques/drafts or Telegraphic Transfer (allow 7 days transaction time.
10.2. A non-refundable card surcharge will apply to payments made by Visa, Mastercard, American Express. Fees will apply to payments made by PayPal. The surcharge applied to these cards may vary and is displayed at the time payment for the booking is to be made.
10.3. If you pay for your booking by cheque:
10.3.1. Post your cheque to the following address: Ceadervale Park Attention: Accounts 229 Cedarvale Road Sandy Creek QLD 4515
10.3.2. You must ensure you include the following details with your cheque:
10.3.2.1. Your booking number reference;
10.3.2.2. the name Your booking was made under; and
10.3.2.3. the dates of Your stay
10.3.3. You must ensure that CVP receives your cheque 5 days before the date Your payment is due to allow time for Your cheque to be cleared; and
10.3.4. if Your cheque has not cleared prior to your scheduled date of check-in you will not be permitted to check-in unless you provide an alternative form of payment.
10.4. CVP accepts no responsibility for monies paid by you to a travel agency until cleared funds are received in the bank account of CVP.
11. Deposit And Final Payment
11.1. For Standard Bookings full payment must be received at least 30 days prior to your scheduled day of arrival or, if your booking is made within 30 days of your scheduled day of arrival, at the time of booking.
11.2. For Peak Season, Mid Peak Season, and Long Weekend bookings full payment is required at the time of booking to guarantee your booking.
11.3. If any deposit or final payment is not received by the due date, CVP reserves the right to cancel the booking and any monies paid by you in relation to your booking will be forfeited to CVP.
11.4. Once final payment of your booking has been made confirmation of that payment and your booking will be sent to you via email or post to the email or postal address you provided at the time you made the booking.
12. Rates And Charges
12.1. The currency applicable to any quoted rates will be specified with the quoted rate. All quoted rates are subject to change at any time until full payment is received.
12.2. Quoted rates are inclusive of all compulsory government or regulatory charges and taxes (for example GST) where applicable.
12.3. Quoted rates do not include transport to or from CVP or items of a personal nature including but not limited to firewood, telephone, taxis, unless otherwise indicated.
12.4. Some rates which are quoted are valid only for a minimum number of nights and if the number of nights included in your booking changes the rate may also change.
13. Amendments
13.1. All amendments are subject to the availability and applicable pricing of CVP at the time the amendment is requested.
13.2. Amendments for Standard Bookings may be requested up to 48 hours prior to your scheduled check-in time.
13.3. Amendments for Peak Season Bookings, Mid Peak Season, and Long Weekend Bookings may only be requested up to 14 days prior to your scheduled check-in time.
13.4. If amendments are requested outside the time frames specified you may be charged a 100% cancellation fee in addition to the cost of your amended booking and any reduction in the amount which is payable by you in such case will be at CVP’s absolute discretion.
13.5. Amendments may be requested in the following manner:
13.5.1. Up to 30 days prior to your scheduled check-in time: via our website, or reservation service by calling 07 5498 1032 or emailing info@cedarvalepark.com.au.
13.5.2. Up to 48 hours of your scheduled check-in time: via our reservation service by calling 07 5498 1032.
13.6. The following charges will apply to amendments requested and approved:
13.6.1. Up to 10 days prior to your scheduled check-in time: no amendment fee will apply.
13.6.2. Within 10 days of your scheduled check-in time: a $5.00 amendment fee will apply.
13.7. If the rate which applies to an amended booking is greater than the rate which applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.
14. Site Allocation
14.1. Site allocation is at CVP’s discretion. Site preference is requested but no guarantee of a particular site is given to You. Your site allows for one car and your camping setup (van/tent/camper trailer) with up to a metre separation to the boundaries. Consult closely with CVP staff and CVP map to know exactly what the layout of your site is and how to best fit onto it comfortably.
15. Cancellation 15.1. For Standard Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.1.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.1.2. Within 14 days but up to 72 hours of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.1.3. Within 72 hours of your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid. 15.2. For Mid Peak Season Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.2.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.2.2. Within 30 days but up to 72 hours of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.2.3. Within 72 hours of your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid.
15.3. For Long Weekend Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.3.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.3.2. Within 30 days but up to 7 days of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.3.3. Within 7 days prior to your scheduled check-in time: a 50% cancellation fee of the first night will apply and you will be required to pay to CVP 50% of the first night’s booking fee less any amount which you have already paid.
15.4. For Peak Season Bookings, if you cancel your booking the following charges will apply in relation to each booking:
15.4.1. Up to 30 days prior to your scheduled check-in time: No cancelation fee will be applied and any deposit you have paid for your booking will be returned.
15.4.2. Within 30 days but up to 14 days of your scheduled check-in time: a Booking Credit to the value of any monies which you have already paid stay will be attributed to You.
15.4.3. Within 14 days prior to your scheduled check-in time: a 50% cancellation fee will apply and you will be required to pay to CVP 50% of the full amount of your booking fee less any amount which you have already paid.
15.5. Any cancellation fees payable by you will be deducted from any monies paid by you to CVP and if insufficient funds are available, CVP may charge, and you authorise CVP to charge, the credit card the details of which you provided at the time of making your booking.
15.6. Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be held by CVP as Booking Credit which subject to clause 10 may be applied to any future bookings you make with CVP.
15.7. Any surcharge applied to credit cards at the time payment for the booking is made will not be refunded.
15.8. The above clauses apply to cancellations due to any of the following:
15.8.1. disease
15.8.2. earthquakes, fires or other physical natural disaster
15.8.3. acts of war, acts of terrorism, riots, civil or military disturbances, national or state-wide industrial disputes (excluding actions by, between or originated among employees of a party); and
15.8.4. requisition or compulsory acquisition by any government or public authority
16. No-Shows Or Terminations
16.1. If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will be required to pay to CVP the full amount of your booking less any amount which you have already paid.
17. Refunds
17.1. Any amount paid by you to CVP for your booking (including deposits) shall be dealt with as stated in these Terms and Conditions.
18. Booking Credit
18.1. If you have been issued with Booking Credit to be applied to future accommodation or accommodation package bookings with CVP such credit will remain valid for twelve months from the day the booking is cancelled.
18.2. Booking Credit may only be used to pay for bookings at CVP.
18.3. Booking Credit may only be used to pay for the accommodation portion of your booking and may not be used for non-accommodation items such as firewood, activities or taxes not included in accommodation rates.
18.4. To redeem Booking Credit you must make your booking via our website, or reservation service by calling 07 5498 1032 or emailing info@cedarvalepark.com.au.
18.5. Any stay to be fully or partly paid for using Booking Credit must be booked and paid for in full prior to the expiry of the 12 month validity period.
18.6. Any Booking Credit not redeemed at the expiry of the 12 month validity date will be forfeited in its entirety to CVP.
18.7. Administration fees may apply to bookings made using Booking Credit.
19. Security Deposits
19.1. You must provide a credit card authorisation or imprint when you check-in and must make full payment for your booking at that time.
19.2. The authorisation may be used to cover incidental items including but not limited to a security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.
19.3. The pre-authorisation process validates your credit card, and protects both the cardholder and merchant from increasing fraud incidents.
19.4. The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit. For more information on this practice please contact your card issuer.
19.5. Once a pre-authorisation has been made, CVP cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer, and cannot be negotiated.
19.6. Where a credit card is not available a minimum $50.00 cash deposit will be required on check-in.
20. Check-in
20.1. Standard check-in time is 1:00pm AEST but times may vary per on season and you should confirm the check-in time with Us prior to your scheduled check-in day.
20.2. If you wish to guarantee your ability to check-in prior to 1:00pm AEST you must book an additional nights stay and pay the applicable rate for that additional night.
21. Check-Out: Standard
21.1. Standard check-out time is 10:00am but times may vary per season and you should confirm the check-out time with Us prior to your scheduled check-out day.
22. Late Check-Out
22.1. If you wish to check-out later than the standard check-out time you must obtain approval from Us at least 12 hours prior to your scheduled check-out time.
22.2. We may approve a request for late check-out in Our absolute discretion.
22.3. If you check-out after 10:00am the following additional charges will be applied to your account and will be payable by you on check-out:
22.3.1. a surcharge of $5.00 per hour for every hour after 10:00am that you fail to check-out; or
22.3.2. if you check-out after 1pm a charge equivalent to the fully daily rate which applies to your booking.
23. Facilities and Services
23.1. Whilst care is taken to ensure that the description of facilities and services of the CVP is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature/facility is essential to you in choosing a particular site or when determining to stay with us, it is
your responsibility to confirm with CVP prior to making your booking that the feature/facility will be available during your stay. 23.2. To the extent permitted by law CVP is not liable for omissions, errors or changes to the facilities and services at CVP, whether temporary or permanent.
23.3. Please report any breakages, damages, downed trees or dangerous animals to CVP.
24. Maps and Images
24.1. Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided
24.2. Destination shots may have been supplied to CVP by third parties and CVP does not guarantee the accuracy of any destination shots.
24.3. Photos and site maps are indicative only. Actual sites occupied may vary in appearance from those shown.
25. Travel Insurance
25.1. CVP strongly recommends that at the time of booking you purchase comprehensive travel insurance to cover items including but not limited to: loss of booking amount through cancellation, loss or damage to personal camping equipment, loss of money and medical expenses.
26. Personal Transportation:
26.1. Mini-bikes, motorised scooters, motorcycles, are prohibited from use at CVP.
26.2. All vehicles must be appropriately registered and operators must have a valid driver’s license.
26.3. The speed limit at CVP is 10kph everywhere and 5kph in the camping area.
26.4. It is prohibited to drive:
26.4.1. on any banks in the camping area;
26.4.2. a noisy vehicle.
26.4.3. under the influence of alcohol or drugs
26.5. All animals and pedestrians have the right of way.
26.6. Beware of trees/limbs that may fall on your camp.
26.7. All vehicles must drive on the tracks at all times.
26.8. All tracks will be closed after rain at the discretion of CVP.
26.9. Please be kind to our neighbours and drive slowly and obey the road rules along the dirt road.
26.10. We have the right to ask guests to leave the CVP if they breach this clause, in which case they will not be entitled to any refund.
27. Caravans, Campervans and Trailers
27.1. All caravans, campervans and powered trailers must have a current electrical warrant of fitness.
27.2. Power leads must be a minimum of 10m in length.
27.3. You must provide own waste container and empty chemicals toilets in dump station provided.
28. Day Visitors
28.1. Day visitors to the park must pay a $10 entry fee. This fee is non-refundable.
28.2. Day visitors are only permitted within the hours of 10:00am to 9:00pm AEST.
28.3. You are responsible and liable for the behaviour of any person staying under your booking or visitor to your site.
28.4. Any breach of these rules by any person staying under your booking or visitor to your site is held to be a breach by You.
29. Hazardous Materials 29.1. Hazardous materials are absolutely prohibited at CVP and includes but not limited to:
29.1.1. hazardous machinery (e.g. chainsaws)
29.1.2. firearms
29.1.3. fireworks
29.1.4. hazardous chemicals excluding the following provided they meet the regulatory requirements and are disposed of appropriately:
29.1.4.1. fire starters
29.1.4.2. gas bottles
29.1.4.3. chemical toilets, porta-loos or toilet cassettes
30. Noise
30.1. At CVP we have noise restrictions between the hours of 10:00pm to 7:00am AEST.
30.2. Music is not permitted without the authorisation of CVP management.
30.3. Noise generating appliances are not permitted without the authorisation of CVP management.
30.4. Where generator use is allowed, there may be restrictions on noise level output and hours of use.
30.4.1. Only low decibel (dB) generators, up to 2.0 Kva, with a maximum noise level output of up to 65 dB at 7 m are appropriate in our camp sites, unless otherwise specified.
31. Fire
31.1. In compliance with the Fire and Emergency Services Act 1990 fires may only be lit within the designated fire rings provided and must not exceed two metres in height, width or length.
31.2. Fires must be monitored by an adult at all times and must be fully extinguished prior to leaving the site and going to sleep.
32. Theft and Wilful Damage
32.1. Any person caught stealing, damaging or destroying property (including plant and wildlife) will be prosecuted and/or required to pay for the damage.
32.2. We have the right to ask guests to leave the CVP, in which case they will not be entitled to any refund.
32.3. Please ensure that you keep all valuables secure, put away recreation equipment, lock your doors and ensure all vehicles are secure.
32.4. CVP and its Related Parties are not responsible or liable for any loss, theft, or damage of your personal property.
33. Abuse of Staff or CVP
33.1. Misconduct, profanity, theft, vandalism and abuse towards staff will not be tolerated.
33.2. We have the right to ask guests to leave the CVP and ban then from future entry, in which case they will not be entitled to any refund.
33.3. Should you refuse to leave or leave within a reasonable time CVP under the direction of our staff you will be deemed as having trespassed. We may within the limits of the law, use reasonable force to eject you and your property from CVP.
33.4. We may contact the authorities to remove you from CVP.
34. Release, Indemnity and Proportionate Liability
34.1. To the extent permitted by the law, you agree to release, indemnify and hold harmless, CVP and its Related Parties from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at CVP except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from CVP’s negligence, wrongful act/omission or breach of these terms and conditions.
34.2. To the extent permitted by law the aggregate of CVP’s liability to you is limited to an amount not exceeding the amount paid by you for your booking.
34.3. Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.
35. Consumer Law
35.1. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on CVP are excluded under these Terms and Conditions.
35.2. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits CVP to limit its liability, then CVP’s liability is limited to:
35.2.1. in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
35.2.2. in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
36. Events Beyond Control
36.1. CVP is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
36.2. All travel documents, observance of laws and government regulations are your responsibility.
37. Use Of Information
37.1. You consent and authorise CVP to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
37.2. You consent to information which you have provided to CVP as part of your booking being used by CVP or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate CVP or CVP’s related bodies corporate.
37.3. CVP will not provide or disclose any information you have provided to CVP to any person other than a related body corporate without your prior written consent.
37.4. Upon request by you and to the extent permitted or required by law, CVP will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

38. General
38.1. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Queensland, Australia.
38.2. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
